Can't spend passive points

Same deal. Mercenary ascended and I spent the two points but passives screen said I still had 2 points up top (but on the right it correctly said I had 0 ascendency points)

Thought running chaos for the second set of points would reset it. Even tried refunding and switching ascendency. No dice. Now the notification bar says I have 4 skill points to spend even though I have none (0 ascendency points still correctly displayed on the right).

On Xbox.

I have same problem. 4 points to spend. It looks like the dev set a cap for the maps you do and you character lever, because i can from time to time spend 1 point.
Maybe they will not that we overlevel to hard?!
