It's very quickly approaching "show me on the doll where it obstructed you".
All it takes is one statement from Mueller saying "I needed X to complete my investigation and it was denied." If it's just oh-so-obvious, where's this one statement? There's 400 pages of a report with not one line being that statement. There's a few memos Mueller himself wrote without that statement. The best the anti-Trumpers can get is "well he thought about obstructing, and asked some people if he could obstruct, but it never actually happened". Nobody cares. |

"Consider this: the OLC policy regarding inability to indict a sitting President has been in place since 1979. Yet Ken Starr, OSC head when Clinton was President, had no problem directly accusing the sitting President at the time of crimes, and explicitly recommended impeachment. So if Starr did it without so much of a peep from Democrats about him breaking OLC policy (and Starr didn't break it, because he didn't recommend indictment), why did Mueller act as if his hands were tied? Answer: Mueller's playing games with the process. "The problem with that, pneuma, is that per 18 USC §1505, directing someone to obstruct is obstruction, regardless of whether that direction is followed. (There is still a burden to demonstrate the investigation was impeded, but the impediment can take any form, to include very indirect means of impediment.) This is why I've been arguing that §1505 is a bad law. In practice, all you need is an investigator to testify the investigation was harmed, and the "how" can be pretty much anything.
