Will the TOS be enforced on everyone that breaks them?

7. Restrictions: Under no circumstances, without the prior written approval of Grinding Gear Games, may you: h. Perform in-game services during your use of the Website, Materials or Services for any form of compensation outside of PoE.

How did you read this part ?

I think reservation of rights shall not be deemed a waiver of rights. Otherwise, we would have to justify everything we do/we don't do and risk being criticized for doing/not doing so.

If they don't give the full access to their own property where they claim it is, there should be something dirty they are hiding ?

Edit
What you share is up to the other person to interpret.
You can change it later without them noticing, but it's still a matter of trust sharing, and it's up to the other person.

I have no idea what you think you're talking about, but "under no circumstances" is explicit and direct. It does not leave room for interpretation.

Let him be; the said cheater (You-Know-Who) is very petty. He has the power to cause significant problems for GGG. While banning him would earn huge respect for the devs, that respect pales in comparison to the potential trouble he could cause.

Not banning him will lose huge respect; it will be a very, very clear case of favouritism. Previous examples of favouritism in the scope of PoE have been received exceptionally poorly; take the existence of the streamer queue, for example.

(there is a high chance) The guy will be a pain in the butt if he decides to use his power to mess up with GGG. I don't want patches to be delays because of him.
He "owns" USA now. He could cause waaay more issue than a regular streamer sadly.

Also, after this drama, he might ignore poe all together, so GGG doesn't need to poke the wasp nest. But idk.

Taking the specific person out of the matter, streamers are essentially an extension of a lot of peoples voices/thoughts/feelings and the "worry" is of what kind of influence is generated.

There's way too much focus on the more "vocal elephant" in the room than the actual product, if the product is not up to standard then people should have a right to criticize said product.

I don't see an "issue", all I see is a dislike for majority and/or focused consumer preference.

Cheating in a game is lame, no argument there. If he's just stirring up trouble for attention, imo let the dude fade into irrelevance. And now I think more about it, him delaying patches or influencing stuff for everyone else, that’s more on the devs.

I trust GGG with their decisions on this.

It is setting a precedence though.

How can GGG enforce banning average Joe when they dont do it for the guy with money that can cause them trouble?

What moral basis do they have to do so?

Will there even maybe be basis for 'average joe' to then seek legal ways to counter an eventual GGG ban?

(Argument is easy: That guy was not banned for something i did, why am i banned)

The "low money joe" will very likely be causing a detrimental amount of problems for GGG to warrant a ban (constant exploitation + duping + RMT and advertising all of them as one example) besides just simply sharing an account with his friend/Mrs/whoever. You can dress up a terms of service to use as multiple amounts of ammunition to remove a customer "rightfully" which will keep the product safe.

At the end of the day, this is a fault with the product (and many other gaming community products) and there is no proper integrity or real competitive realms to be had unless the product is specifically tailored to be so AND the user is precisely monitored on their actions via ways that will very likely break current user privacy laws.

Seriously though, who is playing an exclusively/largely solo experience and getting affected by other peoples actions?
We're talking of morality outside of an mmo experience, if GGG want to inject themselves into a "real gamers vs fake gamers" war, that's on them but its not their obligation to do so, they sell a non mmo experience with "online convenience partying/trading" and a leaderboard which has no real merit on actual user skill and community involvement.
The fault is purely with GGG and other game companies making people believe that leaderboards and other online caveats in their non MMO products have a real investment significance to the user experience. Look at the source and not the immediate problem, this is something that has especially been apparent in Riot Games LoL, there is no removal of toxicity when they're the ones essentially causing it from a foundational/mechanical/advertising/patching standpoint!

Will there be bans for people who break the TOS, even if they are celebrities, streamers and billionaires?

Just asking, because it seems at least 2 people who clearly broke the TOS and even admitted it are still having an account.

TOS are not law. They are a agreements between 2 private parts.. surprise.. if both parts agree any agreement can be ignored.

ToS ? What is that ? Because last time i did read it those subjective rules were not written in it : try to criticize the owner of GGG or the country where it is located and see how it turns out .

GGGs response so far has been to nuke the threads with any mention of the incident. Kind of surprised this one has been up for so long.
Never has, never will. GGG is bottom tier at go after exploits and TOS violations unless their hand is forced. It's head in the sand with these guys.
I was wondering the same thing. I’m not sure if there is a clause in TOS that exempts the rich and/or public figures from following certain rules, but I would love some clarity on the issue. For example is there a specific net worth or revenue that you have to hit? That way we could at least know who does or does not qualify for TOS exemptions.
