Frame rate sometimes locked around 50FPS reset required

RTX 4070 Ti Super
32GB RAM @ 6000 MT/s
Windows 11
DirectX 12
Sometimes when I start the game the frame rate is locked around 50FPS, changing the in game settings does nothing. IE changing windowed mode, resolution, Vsync or any other setting.
If I run it without Vsync when the issue is not present I normally get around 300 - 350FPS in the hideout.
Is this a known bug, will it be getting fixed, or is it an issue with something outside the game so I can follow it up?
Any help would be appreciated because I don't want to have to keep resetting.

similar specs, but Intel instead of AMD and a standard 4070 here.

Normally play on adaptive and get ~160ish fps, but sometimes on reboot I am locked at 50-54 FPS. Sometimes, it's fine.

I had a similar issue when PoE2 first became available but that issue ended up resolving.

Bump - Just hopped on POE1 after months of not playing and noticed this as well. Something to do with updates since the new league maybe?

Ensure Windows 11 Dynamic Refresh Rate is NOT enabled.

System -> Display -> Advanced display -> Choose a refresh rate -> turn OFF dynamic refresh rate
