Bug with Omen of Amelioration?

Omen of Amelioration being consumed when you die in pinnacle fights where you cannot lose XP. Not sure if this is a bug or intended but seems like it should be a bug.

Its been reported a number of times since the league start. Not sure if GGG has ever commented on it.
