Mini boss problem

Any chance of fixing / changing this mini boss behaviour...
He sits in afk mode until you stop attacking and for builds that rely on attacking to stay alive this is just troll (He appears in shaper/uber shaper) also campaign which isn't an issue in campaign, just the uber is annoying
