Raging spirits interactions

I have a SRS + Infernal legion setup, and an active COMD.

Infernal legion kills SRS exactly in 5 seconds (or i can add persistence to make sure they die before expire), but it seems to not charge the COMD.
Same effect with minion instability

Is it intended that killing RS doesnt charge the COMD or its a bug?

0.2 patch notes:

Cast on Minion Death now only gains energy when persistent minions are killed. Additionally, minions that are created by a very underlevelled minion skill (relative to the current area level) now grant less energy when killed. Level 20+ minion skills will incur no penalty in endgame content.

SRS is not a persistent minion.
