Are auras from sceptres suppose to take up spirit?

I upgraded to a different sceptre from 2 skele knights to Malice aura with increased spirit amount thinking I was going to have more arsonist. My surprise is that not only did I not more arsonist but even less! I gained 30 spirit but lose it or it gets reserved for this sceptre. I thought skills from weapons were free?

by chances do your old scepter have + minion skill level? the higher the minion skill the less spirit it consume...
yes it does, also I realized the more supports I put on malice, the more spirit. I always thought all sceptre skills were free..regardless supports, oh well.
wait, malice from sceptre reserves mana? i was going to transition from a rattling one, but not now. this sounds like a bug- rattling sceptre skeleton have no reservation

Only if you put any "additonal spirit cost" supports in it.

ah ok, nvm then lol
Malice on my setting doesn't seem like reserving any spirit.
I could put 3 supports (10+15+20) when I had 13 spirits leftover (no warning or reset on other settings occurred).
I see those support's effect on malice's detail info tab but I'm not sure if it does anything.
Edit
Malice does not give warning when putting a support that costs more spirit than you have. It just goes off along with the effects and costs from support gems all at once. (If I have 15 spirit and put a support with +10 spirit on malice, malice keeps working and reserves 10 spirit. If I add another +10 which is 5 spirit over than I have, the buff goes off and my spirit leftover comes back to 15.)

Context
I use weapon swap. (WS1 with omen sceptre, WS2 with wand)

When I change the skill setting, the game tries to avoid conflictions.
For example, it shows what conflictions are occurring when holding a support gem on the cursor, like "you need xx STR (you have yy)" or "you need XX spirits (you have yy)"

Or deactivates/activates existing spirit skills to match the new condition when I made conflictions by weapon swap.
For example, increase the number of summons on Weapon Set 1 ("0" was set on WS2 before) -> previous setting is cancelled and new setting is shared in both WS1 and WS2 -> Swap weapon -> confliction.

I don't know how but seems Malice is not active and spirit supports on malice do nothing.
The game did nothing random during the process. (I should not be able to put spirit supports without spending spirits but at least I can "always" put them under current setting :P)

Verification

- 189 max spirit on a Invoker with "Lead me through grace..." passive (Ignores additional spirits on items).
- WS1 quarterstaff, WS2 Omen (Malice) sceptre with 134 spirit

Spirit Skills

-WS1 spirit 4/189
Ghost Dance (30)
Grim Feast (30) +accuracy (10) +life on kill (15)
Combat Frenzy (30) +mana regen (10)
Herald (30)
Wind Dancer (30)

-WS2 spirit 64/189
Herald and Wind Dancer is canceled due to incorrect weapon type. The red circle (malice) appears on the ground with WS2.

Seems Malice itself does not use spirits ? (on summoner, the red circle doesn't appear with omen sceptre equipped.)
