Loss of legendary item drops

Apparently if your inventory is full and you try to pick up a legendary item drop it will make it public and anyone who picks it up is unable to return it to you until you are both level 25. I found my first legendary item today but wasn't able to pick up and my brother grabbed it on accident then immediately tried to drop it to give it back but it was permanently locked to his account. I don't understand if this was intended but id have to assume it wasn't. Is there some logical reason for this to happen?
