skill gems and persistent gems

Let me just get to the point.
- Started Witch.
- Tried some skills
- Played around with Chaos Skills
- Got a persistent skill
- Went with the one that gives me wither
- Didn't like the chaos skills
- Changed my build
- Want to play summon raging spirits
- Went to use a persistent skill gem from my stash
- It wont work because its too high level
- I have LOTS of skill gems from different level ranges but all the persistent ones i have are level 10.
- I cant use the level ten because my character isn't high level enough
- I think I should be able to use my level ten to get any level at or below lvl 10.

For example, if my character can't use a level 10 summon raging spirits due to an attribute/level requirement, I should be able to select a lower level and take a penalty in the form of not getting the more powerful version of the gem. essentially wasting the maximum 'power' of the item.


Food for thought:

1. Why do skill gems and persistent gems have to be different? They should just be skills. and if they are going to be different, persistent gems should drop more often at all level ranges

2. OR; just let us select the highest level we can achieve with our current level/attributes and have a 'warning' message explaining that you're going to spend a lvl 10 skill gem for a level 5 skill gem because you dont meet the requirements of the skill.

3. Possibly if there was a +/- next to the level of the gem. Like you click the skill you want to use, and a +/- menu appears under the skill icon.

4. Also, Maybe I just want to get a level 1-2 skill gem in late game. for example, a fire wall for my mercenary to power up the crossbow projectiles as they pass through, I dont actually want a high level because the mana cost/intelligence requirement is extremely high and I dont want to use it for damage so a level 1 fire wall would be good. But i cant get a level 1, because all my skill gems are level 14's.
